DMCA Policy

Crave Digital Inc. respects the intellectual property rights of others and expects all users and creators on the platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to notices of alleged copyright infringement that comply with the requirements set forth below.

1. Filing a DMCA Notice

If you believe that content hosted on Crave infringes your copyright, you may submit a written notification to our Designated Agent containing the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit Crave to locate the material (e.g., a direct URL to the content).
  • Your contact information, including your name, address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.

2. Counter-Notice

If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice to our Designated Agent containing the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or Wilmington, Delaware if your address is outside the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notice, Crave will forward a copy to the original complainant. If the complainant does not file a court action seeking a restraining order against the content provider within ten (10) business days, Crave will restore the removed material within 10 to 14 business days after receiving the counter-notice.

3. Repeat Infringer Policy

Crave Digital Inc. maintains a policy for the termination of accounts of users who are repeat copyright infringers. If a user receives three (3) valid DMCA notices within any twelve-month period, their account will be permanently terminated and they will be banned from creating new accounts. We track all DMCA notices and counter-notices received. Crave reserves the right to terminate any account at any time if the user is determined to be a repeat infringer, even if fewer than three notices have been received. Terminated accounts will forfeit any pending payouts associated with infringing content.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be subject to liability for damages, including costs and attorneys' fees.
